Michael P. Kushner devotes his practice to criminal defense, appeals and civil rights litigation. As a criminal defense attorney, Mr. Kushner has successfully represented defendants in all types of proceedings, including high-profile federal conspiracy trials, state grand larceny charges stemming from an abuse of an employee's position as company accountant, and state insurance fraud charges alleged to have been the result of sophisticated money laundering schemes to defraud insurance carriers and the United States Medicare system.
As an appellate attorney, Mr. Kushner has represented clients with issues ranging from inappropriate sentencing, ineffective assistance of counsel and discreet civil rights issues brought before the Second Circuit Court of Appeals. As a civil rights attorney Mr. Kushner advocates for those individuals whom the police have violated either by excessive force, false arrest and imprisonment, malicious prosecution, or any other civil rights violation. Mr. Kushner has received favorable results for criminal defendants including outright dismissals of felony charges at both the state and federal level and acquittals after trial, suppression of evidence through written motions, and monetary settlements from the City of New York for violations of his clients' civil rights.
Mr. Kushner grew up outside of Niagara Falls, New York and attended college at Niagara University. Following university, Mr. Kushner attended the Vermont Law School and focused his legal training on the necessary aspects to become a successful criminal defense attorney. This included three years of study dealing with the issues presented by false confessions and the video taping of confessions and the effective usefulness of scientific evidence in the courtroom. It was a direct result of this training that allowed Mr. Kushner to successfully defend an individual accused of a major felony in Brooklyn Supreme Court. Mr. Kushner's advocacy for his client brought the records examiner from the City of New York to testify to the impossibility of a key adverse witness's testimony, thus causing the jury to disregard the alleged prosecution's version of events and acquit his client of this criminal charge.
Prior to his association with the Blanch Law Firm, Mr. Kushner assisted in the representation of several high-profile telecommunications companies facing anti-trust and patent infringement challenges. Through his practice with the Blanch Law Firm, Mr. Kushner represents a defendant facing tax evasion charges in the Federal Court for the Eastern District of New York. This client is accused of failing to report income to the United States Government over a 16 year period in amounts well in excess of 1,000,000.
